Arkansas: a liability-only mandate with PIP and UM kept by default

Arkansas requires one auto coverage and leaves the rest to the policyholder. The Arkansas Insurance Department automobile insurance brochure (Rev. 11/2025) says drivers are required by law to purchase liability protection only, and that all other coverages are voluntary unless a lienholder requires them. Liability bodily injury coverage answers claims from people injured in a crash the policyholder is legally liable for.

Two optional coverages are harder to drop than to keep. Personal injury protection comes in three parts (medical payments, lost wages and death benefits), and the brochure says a policyholder who wants none of it "must reject it in writing." Uninsured motorist coverage is included in the policy unless the buyer signs a statement rejecting it, and the brochure cites Ark. Code 23-89-403(3)(A) for the insurer's duty to offer uninsured motorist bodily injury limits up to the liability limits the applicant chose.

PIP reaches beyond the policyholder. According to the same brochure, it covers household members injured or killed in the insured car, passengers from outside the household who lack their own PIP, and any pedestrian or cyclist the insured car strikes. For a pedestrian or cyclist lead, the striking driver's insurer is a field worth capturing.

Arkansas 25/50/25 liability minimums

The Insurance Department brochure (Rev. 11/2025) states that, under legislation passed in 1987 and 1999, it is unlawful to drive in Arkansas without at least $25,000 for bodily injury or death of one person in any one accident, $50,000 for two or more persons, and $25,000 for damage to the property of others.

Uninsured motorist property damage, when bought, carries a $200 deductible per the same 2025 brochure, which drops when the same company writes the collision and UMPD coverage and the uninsured driver is identified and solely at fault.

Where Arkansas sets the fault cutoff

Arkansas's 2003 tort reform act speaks to the fault cutoff directly. Section 7 of Act 649 of 2003, the Civil Justice Reform Act, says the act does not amend the existing law under which a plaintiff may not recover any damages if the plaintiff's own fault is determined to be 50 percent or greater.

Because the cutoff turns on a percentage, buyers ask how the crash happened and who was cited rather than a single yes or no fault question.

Arkansas crash reporting and traffic deaths

Arkansas has its own crash report for financial responsibility. The Department of Finance and Administration safety responsibility page (2026) says an SR-1 accident report must be submitted within 30 days when damage to any one person's property exceeds $1,000 or the crash injures or kills anyone, regardless of who is at fault. Whether an SR-1 or police report exists is a useful field on an Arkansas lead.

For fatal crashes, the NHTSA FARS state table (2023 data) counts 596 traffic deaths in Arkansas in 2023. FARS does not count injury crashes, which are where most car accident leads come from.
