Arkansas is a fault-based state. Drivers must show proof of liability insurance at the limits the state sets, according to the Department of Finance and Administration, and the injured person's claim for pain and suffering runs against the driver who caused the crash. Arkansas Code 23-89-202 adds a first-party layer: every private passenger auto liability policy issued in the state must provide minimum medical and hospital, income disability and accidental death benefits. Under 23-89-203 the named insured may reject that coverage in writing. Those benefits do not remove the right to sue, so intake teams record whether the caller had them and whether they have paid, as context for the law firm.
Arkansas Code 16-56-105 lists actions that "shall be commenced within three (3) years after the cause of action accrues," and the Arkansas Supreme Court has described that section as the three-year statute of limitations for negligence actions (Bodiford v. Bess, 1997). Three years gives firms room to work, but buyers still cap accident age so that treatment records and witness memories are fresh when the case is signed.
The fault rule is Arkansas Code 16-64-122. A claimant whose fault is of a lesser degree than the fault of the party they sue recovers damages reduced by their own share.
