Nebraska drivers buy liability coverage for the harm they cause. The Nebraska Department of Insurance describes bodily injury liability as coverage that pays for medical expenses, lost wages and other costs of injuries sustained by other people, and notes that auto insurance can provide liability coverage for accidents where you are responsible and in a lawsuit. There is no no-fault threshold in the way; a claimant goes to the at-fault driver and that driver's insurer.

The statute that matters most to a Nebraska buyer is section 25-21,185.09. The claimant's contributory negligence reduces damages proportionately, "except that if the contributory negligence of the claimant is equal to or greater than the total negligence of all persons against whom recovery is sought, the claimant shall be totally barred from recovery." A claimant found half at fault in a two-car crash recovers nothing. Liability detail (who was cited, rear-end or not, whether the other driver admitted fault) decides whether a Nebraska lead has value to a law firm.

Timing is generous. Section 25-207 allows four years for an action for an injury to the rights of the plaintiff not arising on contract, the provision that covers negligence claims for personal injury.
