Missouri claims run against the at-fault driver

This section is general information, not legal advice. It summarizes official sources as of October 7, 2026; check the current text of each rule before relying on it.

Missouri has no personal injury protection system. RSMo 303.025 (Revised Statutes of Missouri, as published 2026) bars an owner from operating, registering or keeping the registration of a vehicle, or letting another person drive it, unless the owner maintains the financial responsibility the law requires. A Missouri claimant therefore pursues the driver who caused the crash and that driver's coverage, with no no-fault threshold to clear.

That puts the coverage question near the top of a Missouri lead. Buyers ask whether a police report exists, whether the other driver was insured and who was cited, because those answers decide which policy a firm looks to first.

Five years on the books in Missouri, and why buyers still filter tight

This section is general information, not legal advice. It summarizes official sources as of October 7, 2026; check the current text of each rule before relying on it.

Missouri's period is long. RSMo 516.120(4) (Revised Statutes of Missouri, as published 2026) allows five years for an action for any other injury to the person or rights of another not arising on contract, which covers most car accident injury claims.

A shorter period has been proposed. The Missouri House passed HB 68 on February 20, 2025, which would have cut the period to two years for injuries after August 28, 2025, but section 516.120 as published still reads five years. Buyers should check the current statute before relying on the longer period.

Most desks set an accident age limit far shorter than either number. A recent crash with recent treatment is easier for a firm to document, and fault answers (citations, point of impact, witnesses) let it judge the claimant's share of the blame.

Missouri traffic deaths in NHTSA data

Missouri lost 991 people in traffic crashes in 2023, compared with 1,057 in 2022. Its 2023 rate was 1.23 deaths per 100 million vehicle miles traveled, close to the national 1.26, according to the FARS fatality rate table (2023).

Below are Missouri's eight most populous counties, with St. Louis city listed as the county-level area it is, ranked by the Census Bureau's July 1, 2025 estimates, next to 2023 traffic deaths from FARS. The figures count deaths only.

What buyers in Missouri filter on

The fields Missouri buyers ask for most, and the rule or figure each one answers to:

  • Accident date: measured against the RSMo 516.120(4) period and any change to it.
  • Other driver's insurance and police report: the claim runs against the at-fault driver under RSMo 303.025.
  • Fault answers: citations and point of impact show the claimant's share.
  • Injury and treatment: confirms an injury claim rather than property damage only.
  • Representation status: filters out claimants who already hired a lawyer.
  • ZIP code: sets coverage on either side of the state line in the shared metros.

Where buyers filter in Missouri

Three of Missouri's six largest metro areas cross a state line, so Missouri buyers usually pick ZIP codes rather than whole metros. Populations are the Census Bureau's July 1, 2025 estimates; for St. Louis, Kansas City and Joplin the figure covers the whole metro, including the Illinois or Kansas side.

  • St. Louis: 2,814,421 (July 1, 2025 estimate, whole metro area)
  • Kansas City: 2,270,682 (July 1, 2025 estimate, whole metro area)
  • Springfield: 500,694 (July 1, 2025 estimate)
  • Columbia: 219,062 (July 1, 2025 estimate)
  • Joplin: 208,796 (July 1, 2025 estimate, whole metro area)
  • Jefferson City: 152,712 (July 1, 2025 estimate)

Missouri car accident lead questions

Does Missouri still allow five years for a car accident injury suit?

The published text of RSMo 516.120(4) (as published 2026) reads five years. HB 68 proposed two years and passed the House in February 2025, so check the current statute. This is general information, not legal advice.

How many Missouri traffic deaths involved an unbelted occupant in 2023?

NHTSA's FARS occupants table (2023) counts 354 passenger vehicle occupants killed without a restraint, out of 615 occupants killed.

Can car accident leads be limited to Missouri counties of the Kansas City area?

Yes. Coverage is set by ZIP code, so a desk can take Jackson, Clay and Platte County ZIP codes and leave out Kansas. Leads are exclusive by default.
