Section 941(a) adds property damage coverage of no more than $10,000 per claim, subject to a $150 deductible.

The claim itself is a negligence claim against the driver at fault, decided under the comparative negligence rule below. The injured person pursues the other driver's liability policy and turns to their own uninsured or underinsured coverage when that policy is missing or too small.

Three years from discovery, and the not-greater rule

12 V.S.A. 512(4) (Vermont Statutes, as of October 2026) requires an action for injuries to the person suffered by the act or default of another to be commenced within three years, with the cause of action deemed to accrue on the date the injury is discovered.
