Maine is not a no-fault state. The Maine Bureau of Insurance (as of October 7, 2026) lists three coverages every owner or operator must carry: liability, medical payments, and uninsured or underinsured motorist coverage. A claim for pain and suffering goes against the driver responsible for the crash, with no tort threshold to pass first.

Medical payments coverage is the first money for treatment. 29-A M.R.S. section 1605 (Maine Legislature, checked 2026) sets it at $2,000 for medical payments under section 1605-A. That amount is small next to the cost of most injury treatment, so the liability claim against the other driver carries the case.

Uninsured and underinsured motorist coverage is also required. The Maine Bureau of Insurance (as of October 7, 2026) gives its minimum as $50,000 per person and $100,000 per accident. When the other driver has no insurance or too little, a claimant may still have a source of recovery through their own policy, which is why buyers ask whether the other driver was insured.

Six years to sue, and no recovery at equal fault

Maine's filing window for an injury claim is six years. Title 14, section 752 (Maine Legislature, checked 2026) requires all civil actions to be commenced within that period after the cause of action accrues, unless a statute provides otherwise.

Shared fault is handled by Title 14, section 156 (Maine Legislature, checked 2026). The claimant's own fault does not defeat the claim; the jury reduces damages by what it considers just and equitable given the claimant's share of responsibility. The same section sets a hard stop: a claimant the jury finds equally at fault may not recover.
