Section 41.007 of the Property Code (statutes current through 2025) says a contract for improvements to an existing homestead residence must contain an "IMPORTANT NOTICE" warning printed in at least 10-point bold type. Under subsections (c) and (d), an arbitration clause in that contract must also be in at least 10-point bold type, or it is not enforceable against the owner.

Payment security has its own rule. Section 53.254 of the Property Code (statutes current through 2025) says that to fix a lien on a homestead, the owner and the person furnishing material or labor must sign a written contract before the work or delivery begins, both spouses must sign if the owner is married, and the contract is filed with the county clerk.
