Wyoming is not a no-fault state. An owner of a vehicle required to be registered may not drive it without a liability policy in the amounts in W.S. 31-9-405(b), and W.S. 31-4-103(a) (2026 Wyoming Statutes) makes a violation a misdemeanor with a fine of $500 to $1,500, up to six months in jail, or both. The injured person's claim is against the driver at fault and that driver's liability policy.

Uninsured motorist coverage is the backstop. W.S. 31-10-101 (2026 Wyoming Statutes) bars delivery of an auto liability policy in Wyoming unless it includes uninsured motorist coverage at the bodily injury limits of W.S. 31-9-102(a)(xi), and lets the named insured reject that coverage. Whether the claimant kept or declined it is worth a question on the form.

Four years to file and a fault test that counts every actor

Wyoming allows four years. Under W.S. 1-3-105(a)(iv)(C) (2026 Wyoming Statutes), an action for an injury to the rights of the plaintiff, not arising on contract and not otherwise listed, must be brought within four years after it accrues.

W.S. 1-1-109 (2026 Wyoming Statutes) sets the fault rules. Under subsection (b), contributory fault does not bar recovery if the claimant's fault is not more than 50 percent of the total fault of all actors, and damages shrink by the claimant's share. An "actor" includes anyone whose fault was a proximate cause, party to the suit or not. Subsection (e) then makes each defendant liable only to the extent of its own proportion of the total fault.

For a buyer, the long deadline does not make old accidents equal to new ones: firms still want records and witnesses while they are fresh, and the fault answers show how many drivers were involved and who was cited, which is what the all-actors comparison turns on.

Minimum limits under the Wyoming motor vehicle code

W.S. 31-9-405(b) (2026 Wyoming Statutes) sets the owner's policy limits at $25,000 for bodily injury to or death of one person in any one accident, $50,000 for two or more persons, and $20,000 for injury to or destruction of property of others. The same amounts define proof of financial responsibility in W.S. 31-9-102(a)(xi).
