Liability insurance in Idaho and where a crash claim is paid from
This section is general information, not legal advice. It summarizes official sources as of October 7, 2026; check the current text of each rule before relying on it.
An Idaho injury claim is paid from the liability coverage of the driver who caused the crash. The Idaho Transportation Department vehicle insurance page (as of October 2026) tells owners they must have the vehicle insured with a company licensed to do business in Idaho, and the coverage it lists is liability coverage for injury, death and property damage to others. It lists no personal injury protection benefit of the kind that no-fault states require.
The same page explains that a 2019 Idaho law lets the Division of Motor Vehicles suspend the registration of an owner who has no vehicle insurance. Uninsured drivers still appear in Idaho crashes, so the other driver's insurance status is a field many buyers ask the form to collect.
For a lead buyer, this structure means the questions that matter first are who caused the crash and whether that driver carried a policy. There is no first-party benefit stage to wait through before a claim against the other driver begins.
Idaho filing deadline and the fault questions on each lead
This section is general information, not legal advice. It summarizes official sources as of October 7, 2026; check the current text of each rule before relying on it.
Idaho gives an injured person two years to sue in most cases. In Planned Parenthood Great Northwest v. State of Idaho (Idaho Supreme Court, opinion filed January 5, 2023), the court noted that the general statute of limitations for personal injuries is two years under Idaho Code 5-219.
A partly negligent claimant is not automatically barred, but there is a cutoff. On the Idaho Supreme Court's model verdict form, IDJI 1.43.1 (Idaho civil jury instructions, as of October 7, 2026), jurors assign fault percentages that total 100 percent, and if the plaintiff's share is equal to or greater than the defendant's, they stop without assessing damages.
Fault decides which Idaho claims a law firm will take, and the combined Idaho page cites the state's comparative negligence statute. A buyer working Idaho traffic sets a maximum accident age so a law firm client has most of the two years left at intakeIntakeThe process a law firm or its intake team uses to screen a potential client, collect the facts of the accident and injury, and decide whether to take the case. Glossary, and reads the fault answers (who was cited, which vehicle struck which) before accepting a lead.
Idaho minimum liability limits
The Idaho Transportation Department (as of October 2026) lists three minimums: $25,000 for injury or death of one person in any one accident, $50,000 for injury or death of two or more persons in any one accident, and $15,000 for damage to or destruction of property of others in any one accident.
The per-person figure is a legal minimum. Because a serious injury claim can exceed it, buyers often ask the form to record whether the claimant carries an auto policy of their own and whether the other driver's insurer is known.
Idaho crash and injury counts
The Idaho Office of Highway Safety counted 8,261 injury crashes and 11,859 people injured in Idaho in 2023, out of 27,679 reported crashes, in Idaho Traffic Crashes 2023 (Table 1). The same table shows injury crashes down from 8,443 in 2022.
NHTSA's Fatality Analysis Reporting System records 275 traffic deaths in Idaho in 2023 in the FARS state table. The injury crash count is the closer measure for car accident leads, since most claims come from crashes where people were hurt and survived.
What buyers in Idaho filter on
Idaho buying desks set these fields against the rules and data above:
- Accident date: keeps leads well inside the two-year window the Idaho Supreme Court describes.
- Fault answers: who was cited and how the crash happened, so a firm can judge liability before intake.
- Other driver's insurance: whether the at-fault driver carried the liability coverage ITD requires.
- Injury and treatment: type of injury, first treatment and whether care is ongoing.
- Representation status: removes claimants who already have a lawyer.
- ZIP code: buyers choose the exact ZIP codes their clients serve.
Where buyers filter in Idaho
Idaho coverage is usually drawn as a set of ZIP codes rather than the whole state. The six Idaho metropolitan areas below are listed by the Census Bureau's July 1, 2025 estimates. Lewiston crosses into Washington, so its figure covers the whole metro area. Filters work down to the ZIP code, inside or outside these areas.
- Boise City: 864,243 (July 1, 2025 estimate)
- Coeur d'Alene: 191,864 (July 1, 2025 estimate)
- Idaho Falls: 173,851 (July 1, 2025 estimate)
- Twin Falls: 123,901 (July 1, 2025 estimate)
- Pocatello: 91,591 (July 1, 2025 estimate)
- Lewiston, ID-WA: 65,450 (July 1, 2025 estimate, whole metro area)
