Montana runs on liability coverage. The Commissioner of Securities and Insurance (as of October 7, 2026) puts it plainly: every Montana driver is required to carry liability insurance on their vehicle. Personal injury protection is not among the requirements the Commissioner lists, and claims for injury are made against the at-fault driver's liability coverage.

Uninsured motorist coverage is on by default. The Commissioner's page says that unless the policyholder signs a form stating they do not want it, the agent is required by law to provide it. A claimant hit by an uninsured driver may therefore have a claim under their own policy, which is why the other driver's insurance status is a useful field on a Montana lead.

Montana's three-year deadline and the combined-defendant fault test

Fault is compared with everyone sued. MCA 27-1-702 (Montana Code Annotated 2025) says contributory negligence does not bar recovery if it was not greater than the negligence of the person, or the combined negligence of all persons, against whom recovery is sought. Damages are then reduced in proportion to the claimant's own percentage.

The deadline is three years. MCA 27-2-204(1) (Montana Code Annotated 2025) sets that period for an action on a liability not founded on an instrument in writing, and subsection (2) gives three years for a wrongful death action, with ten years when the death results from a homicide.
