Montana writes flooring into its contractor law by name. MCA 37-45-102(1)(a) (Montana Code Annotated 2025) defines a construction contractor as a person who, in an independent business, offers to undertake or undertakes work on an improvement attached to real estate, "including the installation of carpeting or other floor covering," subject to the exemptions in 37-45-104.

The state license is the only one of its kind. MCA 37-45-204 (2025) states that a political subdivision may not require or issue registrations, licenses or bonds for the same or a similar purpose, while local governments keep the power to charge a general business license fee on all businesses.

The department can fine. Under MCA 37-45-302 (2025), a finding of unprofessional conduct, which MCA 37-45-301 (2025) defines to include misrepresentation in advertising, can bring a penalty of up to $5,000 and suspension or debarment from public works contracts.
