Washington MVA leads: pure comparative fault and a three-year window

Washington assigns crash losses by fault. RCW 46.30.020 says no person may operate a vehicle subject to registration in Washington unless insured under a motor vehicle liability policy at the statutory limits, or covered by self-insurance, a certificate of deposit or a liability bond. A Washington claimant pursues the negligent driver directly, and Washington law sets no injury threshold on suits for pain and suffering.

Personal injury protection is offered rather than required. Under RCW 48.22.085, no new auto liability policy or renewal may be issued unless PIP is offered as an optional coverage, and a named insured may reject it in writing. Whether a Washington claimant has PIP, and whether it has already paid medical bills, is useful context for the law firm but does not affect the claim against the at-fault driver.

RCW 4.22.005 sets pure comparative fault. In an action based on fault, any contributory fault chargeable to the claimant diminishes the award in proportion but does not bar recovery. A Washington claimant found 60 percent at fault can still recover 40 percent of their damages. Buyers still filter on liability, because a claimant who was mostly at fault recovers little, but shared-fault accidents are not automatically dead cases in Washington, and each buyer can set its own liability line.

Timing follows RCW 4.16.080(2), which requires an action for any other injury to the person or rights of another not otherwise listed to be commenced within three years. Buyers still set an accident age filter, since recent accidents are easier for a firm to document and the claimant is easier to reach.

Washington home improvement leads: ownership and 1985 housing

The Census Bureau puts Washington's owner-occupied housing unit rate at 63.8% for 2020-2024, so a little more than one Washington household in three rents. Renters cannot sign for a new roof or replacement windows, so homeowner confirmation is a default filter on Washington campaigns.

Washington's median housing unit was built in 1985, per the ACS 5-year estimates for 2020-2024, so half of the stock predates 1985. Washington buyers generally map ZIP codes to the service areas of the roofers, remodelers and window and siding installers they supply, then split campaigns by project type.

Washington treats contractors as a registration matter: RCW 18.27.020 states that every contractor shall register with the Department of Labor and Industries. The state's home sale cancellation right sits in its retail installment sales law. Under RCW 63.14.154, a buyer who signs a retail installment contract or charge agreement solicited somewhere other than the seller's business address may cancel by midnight of the third day after signing, not counting Sundays and holidays. For other door-to-door sales, the federal FTC Cooling-Off Rule (16 CFR Part 429) gives three business days on covered sales.

Consent records and Washington call and text rules

Each lead carries its TCPA consent record (opt-in language, timestamp, IP address and page URL), so the record travels with the lead to your system.

Washington restricts telephone solicitation under RCW 80.36.390, amended in 2022 and 2023. Solicitation calls may not be received before 8:00 a.m. or after 8:00 p.m. local time, the caller must identify themselves, the company and the purpose within the first 30 seconds, and a caller asked to stop must not call again for at least one year. A person aggrieved by repeated violations can sue. Separately, the Commercial Electronic Mail Act (RCW 19.190.060 and 19.190.040) restricts commercial text messages to Washington residents and provides for damages.
