Virginia's new law on roof claims and contracts

This section is general information, not legal advice. It summarizes official sources as of October 7, 2026; check the current text of each rule before relying on it.

Virginia added a roofing chapter to its consumer law in 2026. The Residential Property Owners Protection Act (Acts of Assembly 2026, chapters 657 and 658) is Chapter 61 of Title 59.1 and takes effect on January 1, 2027. Its core rule, in Code of Virginia 59.1-618 (effective January 1, 2027), is that no contractor may knowingly or willfully pay, waive or rebate all or part of an insurance deductible on repairs to a home insured as owner-occupied.

The same section lists practices a contractor may not use with a residential property owner:

  • offering a rebate, credit, gift, cash, coupon or help avoiding the deductible in returnReturnA buyer's request for credit on a lead that fails agreed standards, such as a disconnected number, a duplicate or a lead outside the filters. Glossary for a roof inspection or a roof damage claim
  • paying or accepting a fee for referring work that property insurance will pay for
  • giving a repair agreement on a claim without a good faith, itemized estimate
  • soliciting with an advertisement that leaves out the required statements on the deductible, unlicensed public adjusting and the Virginia Consumer Protection Act
  • signing a roofing contract without a notice of these barred inducements (the owner may then void it within 10 days) or without a 14-point bold statement urging the owner to check coverage with the insurer

Storms add one more rule. Under Code of Virginia 59.1-619 (effective January 1, 2027), an owner who signs a roofing contract within 180 days of a Governor's state of emergency covering the property may cancel within 10 days or by the official start date, whichever comes first. Violations are prohibited practices under the Virginia Consumer Protection Act. The Board for Contractors license classes and the home solicitation cancellation rule are on leads in Virginia.

Hail records and federal storm declarations in Virginia

Virginia had 78 hail records in the NOAA Storm Events 2025 details file, 31st among the 50 states in that file.

FEMA's Disaster Declarations Summaries show one counted Virginia major disaster from January 1, 2023 through October 7, 2026: DR-4863, declared April 4, 2025, titled severe winter storms and flooding and typed by FEMA as a severe storm. Tropical Storm Helene led to a separate declaration, DR-4831 on October 1, 2024; it is a tropical storm declaration and is not part of the count.

Method: a hail record is one county or forecast zone on one 2025 storm date. A declaration counts once if FEMA's incident type is severe storm, tornado or hurricane, or if its title names one of them; a title naming only severe winter storms does not qualify by title alone.

Virginia homeowners and housing age

The Census Bureau counts 2,266,609 owner-occupied units among 3,365,732 occupied Virginia housing units in table B25003 (ACS 5-year 2020-2024). The 2027 deductible rule applies to repairs on property insured as owner-occupied.

Half of Virginia's housing units were built in 1984 or later. Table B25035 gives a median year built of 1984, and table B25034 (ACS 5-year 2020-2024) shows 43.5% of units built before 1980, with 259,275 units from 1939 or earlier.

What Virginia roofing buyers filter on
