No Pay, No Play and Louisiana's fault-based claims

This section is general information, not legal advice. It summarizes official sources as of October 7, 2026; check the current text of each rule before relying on it.

Louisiana's most distinctive rule for an injury lead is No Pay, No Play. The Louisiana Department of Insurance Auto Insurance Guide (rev. March 2026) says the law prohibits uninsured motorists from collecting the first $25,000 in property damages and the first $15,000 in personal injuries, regardless of who causes the accident. The guide also notes a provision that may let a driver waive the right to make a legal claim for pain and suffering by buying economic-only uninsured motorist coverage.

Outside that rule, claims follow fault. The same guide (rev. March 2026) says liability coverage must be carried on any automobile a person owns and pays for property damage or personal injury for which the insured may be legally responsible. A driver involved in an accident without liability insurance may have a license suspended and registrations revoked for 180 days.

For buyers, this makes the claimant's own insurance status a Louisiana-specific field. A lead that records whether the claimant was insured at the time of the crash, and what kind of uninsured motorist coverage they carry, tells a firm whether No Pay, No Play or an economic-only election could limit the claim.

The 15/30/25 minimums in Louisiana

Each Louisiana vehicle must carry 15/30/25 liability limits, according to the Department of Insurance guide (rev. March 2026): $15,000 for bodily injury to one person, $30,000 for bodily injury to more than one person in a single accident, and $25,000 for damage to someone else's vehicle or property.

After a crash, the Department of Insurance guide (rev. March 2026) tells drivers to get a copy of the police report, no matter who is at fault, and to notify their own insurer. Both insurers investigate to determine liability; if the other driver is found at fault, payments the claimant's insurer made, and any deductible the claimant paid, may be recouped from the at-fault driver's insurer. That investigation is why Louisiana buyers ask whether a police report exists and which insurers have been told.

Uninsured or underinsured motorist coverage on the claimant's own policy pays when the driver at fault has no insurance or too little to cover the injuries, the guide explains. Because a minimum-limit policy can be used up quickly in a serious crash, buyers ask for both the other driver's insurer and the claimant's own coverage.

Traffic deaths in Louisiana, 2023

According to the NHTSA FARS state table, 811 people were killed in Louisiana motor vehicle traffic crashes in 2023, the latest year this page treats as final. FARS counts fatalities only; the injury crashes that most leads come from are outside it.

Louisiana rules on lawyer advertising, referral payments and direct contact

This section is general information, not legal advice. It summarizes official sources as of October 7, 2026; check the current text of each rule before relying on it.

The Louisiana Rules of Professional Conduct (Louisiana Attorney Disciplinary Board edition, amendments through May 10, 2023) number the marketing rules differently from the ABA model:

  • Rule 7.2, Communications Concerning a Lawyer's Services, including paragraph (c)(13) on payment for recommendations and lawyer referral service fees.
  • Rule 7.3, reserved.
  • Rule 7.4, Direct Contact with Prospective Clients.
  • Rules 7.7 and 7.8, evaluation of advertisements and exemptions from the filing requirement.

Rule 7.2(c)(13) begins: a lawyer "shall not give anything of value to a person for recommending the lawyer's services," with exceptions. Rule 7.4(b)(1)(A) addresses unsolicited written contact about a personal injury or accident sent within thirty days of it. Whether a lead program fits these rules is for the buying firm and its counsel.

What buyers in Louisiana filter on

Louisiana intakeIntakeThe process a law firm or its intake team uses to screen a potential client, collect the facts of the accident and injury, and decide whether to take the case. Glossary leans on insurance details more than most states:

  • Claimant's insurance status at the time of the crash: the No Pay, No Play question.
  • Uninsured motorist coverage type: standard or economic-only, which excludes pain and suffering.
  • Other driver's insurance: whether the at-fault driver carried liability coverage.
  • Fault answers and police report: claims run against the driver legally responsible, and the report is the first record of fault.
  • Injury, treatment and accident date: what care has been received and when the crash happened.
  • Representation status and ZIP code: unrepresented claimants in the parishes a firm serves.
