Mississippi law on insurance-paid roof repairs

This section is general information, not legal advice. It summarizes official sources as of October 7, 2026; check the current text of each rule before relying on it.

Mississippi regulates roofing claims through its Insurance Benefits Roofing Repair Consumer Protection Act, Miss. Code 75-24-301 to 75-24-311. House Bill 1408 (2024 Regular Session, effective July 1, 2024) rewrote section 75-24-307. Before signing, the contractor must hand the insured a 12-point boldface notice and a detachable cancellation form. The insured may cancel within three business days after the insurer says in writing that all or part of the claim is not a covered loss.

The amended section also says a residential roofing contractor may not require payment until that period ends, may not represent or negotiate on the claim until the insured has filed it, may not take anything of value from an attorney for claim referrals, and may not offer, pay or rebate any part of the deductible. A post-loss assignment of benefits may only name the contractor as a co-payee and must carry an itemized description and a 14-point notice.

Licensing is handled by the State Board of Contractors. Its FAQ (as of October 2026) says residential roofing over $10,000 requires a Board license, and the Board's rules let a remodeler applicant take a separate roofer's exam for a license marked residential roofer only. After a disaster, Miss. Code 73-59-7 (Board compilation, 2022) lets the Board issue emergency licenses for up to 90 days, which it may extend by 90 more.
